Application for Solicitor, Hawker, or Itinerant Merchant Registration

  1. Solicitor:
    Any person traveling from place to place, house to house, or street to street, taking or attempting to take orders for sale of goods, wares and merchandise, personal property of any nature for future delivery, or for services to be furnished or performed in the future, whether or not such person carries or exposes for sale a sample of the subject of such sale.
  2. Hawker/Peddler:
    Any person traveling from place to place, house to house, or street to street, carrying, conveying or transporting goods, wares, and merchandise, offering and exposing the same for sale.
  3. Itinerant Merchant:
    Any person, who engages in a transient or temporary business of selling and delivering goods, wares, or merchandise within the City, and who, in furtherance of such purpose, leases, uses or occupies any temporary structure, tent lot, street, alley, sidewalk, or any other such place, public or private, within the City for the exhibition and sale of such goods, wares, or merchandise, or for securing orders for future delivery of such goods, wares, or merchandise.

    Once you submit your application, you will need to be available to come into City Hall to be fingerprinted within the next business day. We will call you to schedule an appointment.
  6. Is the business that you are employed by or representing, a nonprofit organization?*
  7. Have you previously applied for registration as a solicitor, hawker, or itinerant merchant with the City of Yorkville? *
  8. Has the applicant ever had a certificate of registration or a license as a solicitor, hawker, or itinerant merchant revoked or received an ordinance violation ticket? *
  9. If yes, please list the location, date, and all details of the revocation or ticket, including events leading to the revocation or ticket below:
  10. Has the applicant ever been convicted of a felony or a misdemeanor? *
  11. If yes, please list the type, date, location, and details of said offense below:
  12. Has the applicant acquainted himself with the rules and regulations as defined in the Yorkville City Code, Title 3, Chapter 7: Solicitors, Hawkers, and Itinerant Merchants? *
  13. Does the applicant intend to comply with each and every provision thereof? *
  14. Applicants must submit the following with their application:
  15. Application Fee (payments will need to be made by check or over the phone with a credit card)
    - Solicitor Application Fee $100.00 - Hawker Application Fee $200.00 - Itinerant Merchant Application Fee $200.00
  16. Fingerprinting Fee - $28.25 (payments will need to be made by check or over the phone with a credit card)
    (All applicants are required to be fingerprinted by the Yorkville Police Department – fingerprinting by other agencies will not be accepted. Upon arrival for fingerprinting, applicants must provide a valid driver's license or state ID. )

  18. Itinerant Merchants:
    In addition to submitting the items listed above, Itinerant Merchant applications must also be accompanied by a signed statement from the owner of the property from which you are proposing to operate your business evidencing permission to conduct business on the owner’s property. Such written statement must include contact information for the property owner.
  19. *Please note:
    If applicant is selling any type of food product that requires attention such as special temperature for storage/preparation, preparing in-vehicle, etc., you are required to apply for a Mobile Food Vendor registration, and are subject to all Kendall County Health Department inspections/regulations.
  20. Waiver and Release of All Claims Form
    Please read this statement carefully and be aware that by agreeing to allow the United City of Yorkville to investigate your criminal/financial background, you will be waiving and releasing all claims for damages you might sustain arising out of the criminal background check and review.
  21. I AUTHORIZE an investigator or other duly accredited representative of the United City of Yorkville or its agents to obtain any information relating to my activities from individuals, schools, residential management agents, employers, criminal justice agencies, credit bureaus, consumer reporting agencies, collection agencies, retail business establishments, or other sources of information. This information may include, but is not limited to, my academic, residential, achievement, performance, attendance, disciplinary, employment history, criminal history record information, and financial and credit information.
  22. I AUTHORIZE custodians of records and other sources of information pertaining to me to release such information upon request of the investigator or other duly accredited representative of the United City of Yorkville or its agents authorized above regardless of any previous agreement to the contrary.
  23. I WAIVE and relinquish all claims I may have against the United City of Yorkville and its officers, agents, servants, and employees, as a result of participating in this background check.
  24. I STATE that I have read and fully understand this Waiver and Release of All Claims Form.
  25. Electronic Signature Agreement

  26. Affidavit for a Solicitor, Hawker, or Itinerant Merchant Registration
    In witness whereof, the undersigned, being duly sworn verifies that the statements contained in this Application for a Solicitor, Hawker, or Itinerant Merchant Registration are true and correct, along with the acknowledgment by the applicant that denial of registration or revocation of registration may occur in the event of falsification of such information.
  27. Electronic Signature Agreement
    By checking the "I agree" box below, you agree and acknowledge that 1) your application will not be signed in the sense of a traditional paper document, 2) by signing in this alternate manner, you authorize your electronic signature to be valid and binding upon you to the same force and effect as a handwritten signature, and 3) you may still be required to provide a traditional signature at a later date.
  28. Solicitor, Hawker, or Itinerant Merchant Registration - Acknowledgement Form.
    If approved to operate as a solicitor, hawker, or itinerant merchant in the United City of Yorkville, you hereby acknowledge the following:
  29. 1) Permitted hours for Soliciting Monday – Friday from 9:00 a.m. – 7:00 p.m. Saturday from 9:00 a.m. – 5:00 p.m.
  30. 2) No soliciting on Sundays or Legal Holidays
  31. 3) No soliciting at any houses with “No Soliciting” signs posted
  32. I agree to follow these restrictions listed above as well as all regulations found in the Yorkville City Code, Title 3, Chapter 7: Solicitors, Hawkers, and Itinerant Merchants.
